Note that the operation the performance of which is
endeavoured which forms the subject of this part of
the Act the operation the correct performance of which it is
in this part endeavoured to secure is the self same
operation neither more nor less as that the performance of
which occupies so constitutes the subject of that
those other parts of the same Act, in which the Prize
Agent is the sort of person looked to for the performance
of it.
This being the case were sinister interest in every
shape out of the question indolence, and negligence,
and accidental enmity ill-will or particular special enmity as well as pecuniary
interest, out of the question, whatsoever provision
served sufficed for securing payment at the hands of the
Agent within one period at one time the anterior point of time would suffice
for pr securing it at the hands of this official person
at the posterior point of time.
But in these two different situations there are
circumstances may be seen by by which in the respect in
question make a natural difference, are made and they are
these.
In the case of the Agent so long as he is permitted
it is allowed to him to keep any of the trust money
in his own hands, as the interest principal claimant in respect of
his interest has much to fear from the rapacity on
the part of the Agent Trustee, not so much from indolence
or negligence, whereas in the case of the Treasurer's deputy
if so it be that he does not find means to keep any
of the money in his hands, the principal has nothing not any thing to
fear from rapacity, but whatever in this case he has to
fear, it is only from
indolence or negligence
setting aside the case
of casual enmity
that he has to fear it.
