Obligatory dealings
simple and compound.

Of obligatory dealings in this nature some are with reference had to humans simple others complex
are more or less complex or say compounded: compounded
in some way or other of those which are simple.

First of simple: this the
synthetic course.

Let us begin with those which are most simple:
proceeding from them to those which are more and more
complex: to the recipient mind of the receiver of the information, this
course is assuredly the course of any that could be pursued.
Of the two opposite courses of proceeding — the one
synthetic to wit and the analytic, this course is the synthetic.
The analytic course ca takes taking in hand the aggregate of compound
of all the subject matters of consideration, and resolves it th
into those its constituent elements.

They are Pacts or obligatory
promises, or conveyances &c

Obligation A Pact or say an obligatory promise, and
a Conveyance or say acts an act of transmission by or in dealings compounded of the kind
under one or other of
these appellations were obligatory made by law obligatory dealing between more and
more may be designated. comprised.

1. A Pact, the simplest.

1. Of these the most simple to conception is the
obligatory promise, in one word and that a word the use
of which commenced in Roman-bred law — a pact. In simplicity This it
will be seen surpasses the conveyance.

In this two persons engaged, —
Promiser & Promisee.
The promise is a
declaration by promiser
to render a Service.

In the case of a pact, two persons at least must
have place: the one the utterer of the promise, or say in one
word the promiser: the other the intended receiver of that same promise.
Subject matter of the promise serving in a certain shape to
be rendered by the promiser to the intended receiver: suppose the service
rendered, a correspondent benefit is conferred.

The promise is a declaration made by the promiser
of an intention entertained on his part to render the service promised.
