Art. 1. Defendant sincere

Art. 1 So far as on both sides, and in particular
on the defendant's side, sincerity is either or unsuspected,
same for same, the direct may give way to the
collateral ends of justice. In the view of to a granting

to one party individual in the character of pursuer,
no due indemnification although justly due for
a loss say of £1, the Judge will not be instrumental
in occasioning to another individual in the character
of a defendant, pecuniary circumstances suppose the same a loss say to the amount of £5
if necessary to be incurred in advance for the purpose
of judicial self-defence, even the mitiatery loss on that
side by the supposition the wrong side, sure to be alternate and
conclusive: much less when it is considered, that although
to judge from the statement on the pursuer's side, it is
on that side that the right is and thus the wrong on the Defendant's,
yet when the Defendant's side comes to be
heard it may turn out that the reverse is the true state
of the case and that in the addition to the £5 costs on
the Defendants side, thrown upon him by the result of
the mutual enquiry, he may have remain burthened
with the costs, whatever they are which he has found necessary
to incurr on his own part for the hope of fixing
them on the Defendants side
