<p>Art.  Of the <add>modes or</add> causes of complexity in a suit,<lb/>
 
non-penal and penal, examples are as follows –</p>
<p>1.  Complexity of the subject matter of the demand.</p>
<p>2.  Multitude of the elementary collative facts<lb/>
necessary to the completion of an appropriate<lb/>
efficient cause of right or title.</p>
<p>3.  Multitude of witnesses or of sources of written<lb/>
or real evidence.</p>
<p>4.  Length or multitude of operations necessary<lb/>
to effect <add>produce</add> effective forthcomingness in relation<lb/>
to any one or more sources of evidence.</p>
<p>5.  Where a habit or<lb/>
custom constitutes or<lb/>
enters into the composition<lb/>
the efficient<lb/>
cause of right or title,<lb/>
multitude of the elementary<lb/>
facts contained<lb/>
in it, coupled with<lb/>
the multitude of the<lb/>
pieces of evidence that<lb/>
may be respectively<lb/>
adduced in proof or disproof<lb/>
of those same elementary<lb/>
facts.</p>
<p>6.  Multitude of parties on either or both sides<lb/>
of the suit.</p>
<p>7.  Multitude of parties on the Defendant's side<lb/>
of the suit.</p>
<p>8.  <add><gap/> operative</add> Causes of non-forthcomingness on the part<lb/>
of persons or things, the forthcomingness of which<lb/>
is necessary either to rectitude of decision, or<lb/>
to accordant execution:  whether for the purpose<lb/>
of evidence-yielding, or for the purpose of<lb/>
justiciability:  that is to say, of being rendered<lb/>
the subject matters of appropriate and accordant<lb/>
execution, as above.</p>
<p>9.  Multitude of demands on one or both sides<lb/>
of the suit.  On the <del>plaintiff's</del> <add>pursuer's</add> side, name of<lb/>
the demand the original demand, or say <del>Plaintiff's</del> <add>Pursuer's</add> demand.  On the <del>defendant's</del> <add>Defender's</add> side, name<lb/>
of the demand, counter-demand.  Such demand<lb/>
is in effect a distinct suit, in which the Defendant<lb/>

<p>10.  A suit which is complex in respect of the multitude<lb/>
of demands, is resolvable into as many simple<lb/>
suits as it contains demands.  A suit, having for the<lb/>
subject matter of it's demand,<lb/>
a settlement of<lb/>
an account, is resolvable<lb/>
into as many simple<lb/>
suits as the<lb/>
account contains<lb/>
items.</p>

§. 1. of Service

Art. Of the modes or causes of complexity in a suit,
non-penal and penal, examples are as follows –
