Procedure Code
Art. 15. If it be on the Pursuers side that the
supposed deficiency has regard as having is supposed to have place, there will not commonly be much difficulty.
The Judge will determine on what terms the
absentee shall be admitted let in to take come in and take claim
the benefit his share in the benefit of the demand, and within
what time: and taking measures before the at the same time
of the hearing for ascertaining the means of judicial intercourse with
such absentee.
Art. 16. In the terms or conditions thus to be
settled will be to be included – 1. payment of the cost absentees share
in the costs of the pursuit, incurred and about to be incurred:
2. ulterior security of further needful for compensation
for delay vexation and expence at the charge of the
Defendant's side.
Art. 17. If it be on the Defendants side that
the supposed deficiency is supposed to have regarded as to have place,
the Judge will consider whether it be to the disadvantage advantage

non-forthcomingness of the supposed person who it is supposed to
might with propriety be made Co-defendant, is likely to
operate.
Art. 18. If the demand be simply requisitive
and the the matter for consideration will be whether
it may not be conducive to the ends of justice, that without
waiting for concurrence or opposition on the
part of the eventual Defendant, a part be provisionally
set aside for allotted to him and committed to the care of some
person or persons as trustees on his behalf.
