Penal CodeCh. IV. State of the Mind delinquency

1.
In case of a middeed
the misdoer's mind
must be in one of
the three states.
Evil consciousness,
temerity, or blameless
error.

2.
Evil consciousness
has place where the
evil result is among
those expected and
endeavoured to be
produced by the misdoer.

3.
Temerity where the
misdoer was not aware
of the evil result,
but might have
been, had he shown
due attention to the
nature of the case.

4.
Temerity may have
place either through
inadvertence or mis-supposal.

5.
In the case of inadvertence,
the fault
negative – inattention
to the evil consequence.
In the case
of mis-supposal, the
fault positive, entertaining
an idea
which a due degree
of intellectual energy
would have shown
to be erroneous.

6.
On these several states
of the intellectual mind
depends the demand
for punishment.

In the first place
on account of the
difference between
evil of the 1st. and 2d.
order in the two
cases.

Case I. Evil consciousness
both as to fact
and law. The evil
result expected, so
that this state of
things is amongst
those marked out for
punishment.

Case II. Temerity as
to negligence – temerity
as to mis-supposal.
In both cases,
the evil of the 2d.
order stands upon
the same footing.

As to demand for
punishment.
1. Suppose evil consciousness,
the punishment
must be
sufficient to deter
persons in general
from the like acts in
future.

11.
Suppose temerity, the
punishment must
be merely such as
to induce men to
take more care on
similar occasions
in future.

The state of the
mind, by which the
evil of 2d. order may
be done away, may
be either occasional
or permanent.

13.
Permanent, as in
the case of non-age
and insanity.

14.
In the case of non-age,
it will be less
and less as the age
is less and less.

15.
So in the case of
insanity.

16.
The act and evil
of 1st. order remaining
the same, the
evil of 2d. order
will be present
or absent, greater
or less, according
to the following circumstances.
