Law AmendmentPropositions.
Ch. II. Codification or
Ch. III. Remedies
2. Suppressive

69.
2. Capacity of a Private
Offence to be rendered
semi-public, by multitude
of persons affected.
Natural here the
conclusion that the
quantity of evil inflictible
for suppression
and punishment
should be proportionable:
but erroneous:
because, by destruction,
or even
purgation of the maleficent
instrument
suppression of the
evil might be made
sure.

70.
Example. Regent's
Parti Canal Establishment.
Suppose that,
for want of sufficient
change of the
water, deaths, more
or less numerous
have been produced:
maleficent effect,
semi-public morbification
and homicide. Yet,
1. Evil consciousness,
none.
2. Hence, permanent
danger or alarm
none, supposing an
adequate increase
of velocity to the
current, thence
change, producible.

3. This act maleficent,
is it an offence
civil, or criminal,
or both?
Questions these wh.
have no ground but
on the Existing system,
with it's ill-grounded
distinctions
between criminal
and civil cases,
and correspondent
species of suits:
sources of uncertainty,
authorized depredation
and oppression,
as to which see
below – title Existing
System
.

1. Case 1. Maleficent act
transitory or continuous,
according to the circumstances
of each individual
case.
Remedies suppressive
the same as the Preventive.

7xx
By continuity or repetition,
an act of wh.
if transitory, the maleficence
is next to
nothing, it may be rendered
excruciating &
even morbid.

11+
Adapted to the maximum
of the acts maleficence,
must be the
force of the aggregate
suppressive remedies
applicable.

20+
Act quasi continuous
cohabitantcy, stationary
or ambulatory,
a circumstance necessary
to keep tormentee
under power
or tormentor: common
receptacle,
some small island,
ship, efficient apartment,
regiment.

20++
Confinement may
be
1. Stationary, or
2. Ambulatory.
Say
Antecedent operations –
1. Prehension.
2. Incarceration.
3. Confinement ambulatory
by concomitantcy.
