5. Power. Power considered with relation to the
branch of law by which it is conferred has been
divided into private or domestic, and political or
constitutional. Private power is others power of
persons things, or power of persons. Power over things
is the same thing with property in things. The name of Power
of persons is a name given to a particular modification of given to that branch of property
which consists in a right to services, a right
on the part of one individual to cause services of
a certain description to be rendered rendered to him by
another. In both instances power is a word
either another name for property or a particular modification
of property, and the case of provision made by the law for this species of
possession is comprized in the provision made for
security.

Pow The word power is often used in an absolute
sense way, and without any such proportion as over
in its train. Their wealth is spoken of as being power
or an efficient cause of power, and that even in
relation to persons: although at the same time that the power it gives
can scarcely be said to be exercised over that the persons
in relation to whom it is, and with propriety may be
said to exist.
