Your Lordship's office gives to an Act of Parliament,

when Noble Lords have "e<hi rend='underline'>xamined &amp; understood th</hi>e

of this Act, is to cause a Penitentiary House or

Houses one or more to be erected for the whole

kingdom, for  applying the Penitentiary discipline

to Convicts of all descriptions. This not meeting the

views of the Duke of Portland, principles are laid

down by him, according to which no Convicts of

any one description whatever are ever to be put

into it, except in a case whi<del>l</del>ch is never to take

place.  Not a Convict is to be sent out of any
<lb/>
one <sic>Gaol</sic> till it has been crowded to the verge of
<lb/>
"absolute necessity" and this is an event that is
<lb/>
never to take place <del>becau</del> because before it does
<lb/>
take place the bare apprehension of it is to cause
<lb/>
a roomier <sic>Gaol</sic> to be built. Parliament has one
<lb/>
plan about these people: the Duke of Portland has
<lb/>
another. Understanding the object of Parliament

he makes no secret of his "inclination" to do by it
<lb/>
what, having power so to do, he has done by it &#x2014; to

defeat it. Defeat the object of an Act of Parliament?

&#x2014; why ? &#x2014; because according to the Duke of Portland

it would be very inexpedient to pursue it.  It would

defeat the more expedient plan which this servant

of the Crown has formed for the disposal of the

persons in question, in spite of Parliament viz:

Such (Your Lordship sees) is the treatment which
