Question I.

Why offenders are all punished all substantially
upon nearly the same footing.

Reasons

Why the a prime mover is directed to be punished
[] more severely than any other co-offender,
even than the a perpetrator.

Reasons

1. Because his disposition is the worst.
1. Because it argues a worse disposition to be the
first to propose a crime, than to come into it when
proposed by others. In the latter case the offence
seems to receive some sort of countenance from the
moral sanction, in as much as one person at least of
those whose sentiments go towards making up the force of
that sanction, that is one person within the circle
of the offender's acquaintance, instance instead of disapproving,
appears (by the supposition) to approve of
it. Such is the effect of what is called the force of

2. Because punishment thus applied affords the best chance of prevention
2. Because a punishment of a given magnitude
affords a better chance of preventing the obnoxious event
when levelled at the prime mover, than when levelled
at any subsequent offender. Although the punishment
