So also in offences attended with peculiar
aggravations. if the Where the aggravation
is taken from a condition or situation relation which is
peculiar to the offender — no person accomplice who is not in
that situation shall be punished with the punish-
adapted to that condition or situation.

Exposition

Thus in Simple corporal injuries, if although the party
injured be a woman, and the perpretrator be a
man, yet if the instigator be a woman, the perpretator
only and not the instigator shall suffer
the extra punishment in that case

Instructions to the Legislator

Here go on exhibiting a catalogue of the several
aggrav offences which have aggravations appertaining
to these aggravations taken from the some relation of in
belonging the party to the offender, and of those
aggravations respectively, and apply to each offence case
