Punishment X Crime
A Punishment differs from a Crime no otherwise
than in this — viz. that whereas the pain of the
2d is inflicted by a private person in prosecution of
his own purposes, the pain of the 1st is inflicted by to which it is
the Magistrate in prosecution of the purposes of the
community — both are alike evils — equal evils
as far as they produce
