<p>That, to save the expence &amp; delay of a Chancery<lb/>
Suit, on a ground of such intricact, &amp; in which<lb/>
such a variety of evidence, <sic>antient</sic> &amp; modern, written<lb/>
&amp; oral, may require to be investigated, produced,<lb/>
&amp; commented upon, a clause be inserted for submitting<lb/>
all such differences to arbitration &#x2014;</p>


<p>That a valuation be made of the whole<lb/>
of the Waste, including as well the reserved portions<lb/>
as above as the portion proposed to be<lb/>
leased out to the Crown: &amp; that, if the share<lb/>
adjudged by the award to belong to the Dean &amp;<lb/>
Chapter be greater in value than the part hereby<lb/>
proposed to be reserved to their use in kind, a<lb/>
proportionable part of the pecuniary equivalent<lb/>
be allotted to them accordingly: if less, that in<lb/>
that case, the reserved part as above be charged<lb/>
with a proportionable sum or annuity to<lb/>
be paid by them to the use of the Parish or<lb/>
Parishes.</p>
<p>NB - The possession of the satisfaction reserved<lb/>
in kind, seems more competent to<lb/>
the situation of the Dean &amp; Chapter than to<lb/>
that of the Parish or Parishes &#x2014;</p>
<p>1. Because the management &amp; improvem:<hi rend="superscript">t</hi><lb/>
of Land seems a function better adapted to the<lb/>
condition of a small &amp; permanent body, such<lb/>
as the Dean &amp; Chapter, than to that of a numerous<lb/>
&amp; in some measure fluctuating body, such<lb/>
as the Vestries, <hi rend="underline">select</hi> as they are, by which the<lb/>
business of the Parishes is conducted &#x2014;</p>
