<p>Art.36. And to the end that the coercive powers<lb/> thus given for the security of the public may<lb/> not be perverted to purposes of private wantonness<lb/> or malice. Be it enacted that any person<lb/> who rashly and without probably cause shall<lb/> on the pretence of the aforesaid forcibly compel any<lb/> such exposure as aforesaid either in the instance<lb/> of a person who not having been a Penitentiary <lb/> Prisoner has no such mark or who having been<lb/> a Penitentiary Prisoner & having such mark<lb/> is neither a fugitive nor a deserter as aforesaid<lb/> nor upon probable cause suspected of having<lb/> committed any such Post-liberation felony as aforesaid<lb/> shall on conviction as aforesaid forfeit to<lb/> the informer any sum not less than 2 nor<lb/> more than 20: and any person who through<lb/> wantonness or notice shall so compel any such<lb/> exposure, shall in the manner forfeit any sum<lb/> not less than 10 no more than £5: and this in<lb/> both instances without such convictions being pleadable<lb/> in bar with respect to any such further damage<lb/> as might otherwise be inflicted or such damages<lb/> as might otherwise be recovered in ordinary<lb/> course of law.<lb/> <add>Art.37.</add></p> | |||
