5. 1. Of this case the simplest modification is that where
a print is made to two persons at once with benefit
of survivorship. Where While they are both alive, the
profit emolument is to be shared equally between them: when either
dies the whole is to be enjoyed by the survivor for the remainder
of his life.

Thus much as to emolument, in the division of
which, at least in the adjustment of the respective shares
no natural difficulty occurrs. As to duty the
division of it operation of adjusting the shares is not quite so simple quite so free
from difficulty: witness Mr Physician General Sir Lucas
Pepys, witness Mr Surgeon General Keating, witness
Mr Inspector General of Hospitals.

Strike off the survivorship a case will be is made
that will be seen to be still more simple. It is will however
a case that will not easily find means to come
into existence. To declare upon the collation of a mass of emolument that a man shall cease to
enjoy it as soon as he himself shall cease to have
is no hardship: but to declare that he shall lose it
as soon as another person shall cease to have would be
seen by everybody to be such a hardship as no man
would willingly submitt to, nor any other man to whom he
were an object of favour, be forward to impose.
