<p>Of the secret and open<lb/>mode, which is preferable,<lb/> depends on voter's situation</p>
<p>1. Mode secret, the voters<lb/> vote is exempt from<lb/> all external, influence<lb/> tutelary, as well as<lb/> seductive.</p>
<p>This situation is favorable<lb/> to the universal <lb/>interest, so far<lb/> as the voter's personal<lb/> interest is in alliance<lb/> with it, or not hostile<lb/> to it.</p>
<p>2.</p>
<p>2. Mode open, the voter's<lb/> vote is exposed to<lb/> external influence<lb/> from all quarters, tutelary,<lb/> as well as seductive viz.<lb/>1. To the intimidative<lb/> and corruptive influence<lb/> of rich and powerful<lb/> individuals.<lb/>2. To the tutelary influence <lb/> of the Public Opinion<lb/> Tribunal.</p>

<p>Cases, in which the<lb/> secret mode is preferable, are<lb/>1. Where voter's personal<lb/> interest forms part of<lb/> the universal interest;<lb/>as in election of Legislators<lb/>2. Where, it is not out-<lb/> weighed by greater<lb/> damage to interest of<lb/> other individuals.</p>

<p>11. Cases in which the<lb/> open is preferable,<lb/>1. Where the voter's personal<lb/> interest is adverse<lb/> to the universal interest.<lb/>2. Where it is adverse to a<lb/> greater interest on the<lb/> part of a greater number<lb/> of individuals.</p>

<p>Conclusion as to different<lb/> situations.<lb/>1. In situation of Electors<lb/> of the members of the Legislature,<lb/> the secret mode<lb/> is preferable.</p>

<p>Reason. The majority<lb/> w<hi rend="superscript">d</hi>. be exposed to the danger<lb/> of being forced <del>to the</del><lb/> or allured to give their<lb/> votes to unapt candidates<lb/>deemed by the voters themselves<lb/> unapt: and thus<lb/> sacrifice to that sinister<lb/> interest the universal<lb/> interest in which their<lb/> own is included.<lb/> Hence in the Election Code,<lb/> the secret mode<lb/> alone is employed.</p>

<p>2. In the situation of<lb/> members of the Legislature<lb/> In this situation, every<lb/> voter will be under<lb/> the influence of two<lb/> conflicting pwoers.</p>

The intimidative<lb/> and corruptive and <lb/> thus seductive power<lb/> of the Prime Minister<lb/> and Ministers in their<lb/> character of locators as<lb/> to desirable officials<lb/> situation, conferable<lb/> on or withholden <lb/> from those with whom<lb/> the voters all connected<lb/> by self-regarding or<lb/> sympathetic interest.</p>

<p>2. The tutelary power<lb/> of the members of the<lb/> community at large,<lb/> in their character of<lb/> d<hi rend="superscript">o</hi>. of the Public Opin.<lb/> Tribunal, &amp; d<hi rend="superscript">o</hi>. of the<lb/> Constitutive authority<lb/> with it's dislocative<lb/> powers.</p>

<p>Hence, one reason for<lb/> minimizing the seductive<lb/> power of those<lb/> functionaries &#x2014; Measures for this, are<lb/>1. Minimizing the value<lb/> thence the seductive power,<lb/> of those situations<lb/>2. Narrowing the choice<lb/> of those locators, as much<lb/> as possible; viz. by exposing<lb/> them to the punitive<lb/> power of the members<lb/> of the Public Opinion<lb/> Tribunal and of the <lb/> Constitutive Authority, <lb/> in the event of their <lb/> locating persons other<lb/> than those pointed out<lb/> as most apt by the suffrages<lb/> of the official<lb/> talent Judicatory.</p>
