Of Punishments In General
cancelled by a day's Imprisonment: insomuch that the
offender may at any time buy off any part of the Imprisonment
as for as he has wherewithal.
Case in which
Fine may be Converted
to Imprisonment.Although a pecuniary punishment only should
be appointed by the Law there is one case in which the
Judge may convert it, or a part of it into Imprisonment:
to wit where there appears reason to believe that
the Defendant is supported by a person or set of
persons who were associates in, or at least are approvers
of, the Offence; which person or persons will discharge
or contribute to discharge the fine.
For it may happen that there shall be good
ground for suspecting such a confederacy, although these
should not be proof sufficient to convict any person
as a confederate: for instance in all party offences.
