§. Small Debt Courts. Scotch and English.

Second source of elucidation for the here
proposed summary procedure system — the Small Debt Court System. But, to
this there are two distinct and in many respects different branches —
Hitherto two objects [and no more than

of them, thence it is that it is to the Scottish system that
on the present occasion, for the present purpose, that precedence
is given, though English alone is the law for which
and English alone the readers are, for whom, the instruction
is designed. of them. A continued tract — cultivated, marked
out and mapped, is the Scottish System: a few spots, cultivated
indeed, but all of them upon a system more or less different;
set down in the boundless waste, at vast and
immense distances one from another, like the Oases
in the African desert, compose the aggregate extent of the
local field, of the aggregate of the English Small Debt
Court stiled in the Stat. 27 G.2.c.16.§.2 "Courts of Request
and Conscience."

Litigation in Cases of Small Amount in the Sheriff's
