The endeavours
of preventive legislation
are levelled
either 1. against
the act itself: or 2. against
its mischievous
effects
The business and only business of legislation, or at any rate
so much of it at least as we are now considering, is to
prevent avoid exclude mischief. Now there are two ways in methods by which
the business of preventing excluding mischief may be
endeavoured to be compassed at:
1. that by of preventing the acts thems from
which mischief is expected to arise: 2. that of by excluding
the mischief itself, although the acts from
which it is expect might otherwise arise, should
happen to have taken place.

To begin with the first of these methods. The mischief in question as any sort of mischief
considered in so far as the agency of man whether
positive or negative as in a way to be concerned
its production. To prevent it then there needs
no more than to prevent any one [of the number]

on his part is a condition necessary to the happening of that
event. These circumstances, be the obnoxious event what and
