of punishment is but a choice of will.
nothing that bears the name of punishment
is to be approved of by itself: and that
all that can be done by man on such an
occasion is to exhibit a punishment which
for the purpose it is applied to shall be as
liable to objection as any others that can

to reject any mode of punishment a
man should always be prepared to assign
a better one just as if it achievable : that the
triumph of new mode of punishment
is to be governed by the total results of a
multitude of considerations : and that therefore
a mode of punishment which might at first view
might appear suggest itself as being preferable to that in question,
might on a more particular examination be found on some account or other to be absolutely
improper unacceptable to the case.
