Indirect Legislation

Satisfying

In France there are the laws against premeditated
duelling are severe: but means have been
discovered hit upon to elude them. [When they agree] In agreeing to
fight [they] people agree to quarrel by way of prelude.

In England different severe as the letter is of the law is in this point , the
practise of the law it is as indulgent as could be
wished. To lawyers indeed, poison a man or
kill him in a duel it is all one. But in the latter case Juries
acquit; or at the worst find it manslaughter, which
in practise comes almost to the same thing.
Here In this as in many other points The people are better guided by their instinct,
than lawyers by their reason. Here On this
occasion however as on so many others it were
to be wished that the effect produced were produced
by other means: without the breach of
oaths, or the subornation of the law. v. §.
