are without other offence denominated Rogues
and Vagabonds and made committable besides
being repeatedly whipped or ind made committable for the
first offence for a term six months and upward,which may amount
to near nine months, and for a second offence to may be
for the term of two years capable of being forcibly may be afterwards forcibly afterwards
inlisted in his Majesty's service by Sea or Land
without any option in respect to the same and
may moreover and for the a second fresh offence committable committed
fro two years And whereas the Pt Person
to which a person Penitent person reduced to
the aforesaid predicament aforesaid be committed for two years and that
to a common House of Correction in which
no such means of employment and of amendment
are to be found And Whereas by a
statute of the fifth year of Queen Elizabeth any person in
with under between the ages of 12 and 60 under certain exceptions under none of which are
applicable to the case of a discharged Penitentiary
Prisoner may be compelled to serve in
husbandry by the year be retained to serve by
the year provided it be in husbandry and
that with any person that keepeth husbandry
and will in any place within any shire require him so to serve
And whereas the offenders for above punishment and
reformation the said Penitentiary Establishment as designed would
otherwise under the Laws already subsisting existing have been transported
though under sentences for limited terms to Comm Countries from to
which unless by great accident they would by reason of the natural
impossibility
