Simple afflictive Punishments.

a state of liquefaction. In our Law it is unnecessarily
employ'd for the purpose of producing
a permanent discolourment.⊞ ⊞ The instrument made use of is a hot iron. It is also directed to
be employ'd in one case upon the stump after
an amputation of the hand.† † By Stat. H.8.c.

In this case, it is by virtue of its chymical powers
that the instrument produces its effect.

The pains produced by the punishments we
have been hitherto considering are all of the acute
kind. There is one mode of species of simple afflictive punishment
here practised or at least liable to be practised
here in England in which the pain is of the
uneasy kind. This is that of Ducking. The
patient is a fasten'd in a chair or stool, called
the Ducking Stool, and plunged repeatedly
under water. The pain physical uneasiness⊞ ⊞ (for with the shame we have nothing to do at present) arises partly from
the cold, partly from the temporary stoppage
of respiration. It is This punishment for has been applied to such persons
especially of the female sex, as have been
convicted of the offence of scolding.

The instrument of punishment in this case is
fluid! to wit water: and the powers to a by which
it produces its effect are purely physiopathological.
