No 7. Transgression the 11th in England – "Illegal and
"cruel punishments inflicted."
Analagous transgression in New South Wales. Perpetual
exile accompanied with perpetual confinement, and
perpetual slavery, inflicted on his Majesty's subjects altogether
without cause, and whatever offences they had been
convicted of having been previously expiated by appropriate lots
masses of punishment marked out by punishments according to law. For the Of the more practicable endeavours have altogether
to escape from this combination of "illegal cruel and cruel punishments" another an additional lot of
illegal punishment, illegal whipping, as the appointed consequence.
Under this head the enormities committed under imputed to as it is said by under James
the 2d with grief I say it! but how it is possible
to avoid saying it?) were more peccadillos, in comparison
of the the more palpably "illegal", more "cruel"
and above all prodigiously more numerous enormities of the like complection

(a) This most striking of instances alluded to in the Bill
article of the Bill of Rights was the whipping (and
certainly a most severe one) of Titus Oates. But the
crime for which Oates thus suffered had b was but one in a
system of the most murders of the most horrific and atrocious
complexion, murder by the hand of justice though loss
out of that class denomination in the early and dark ages of our laws of murder by the shortsightedness of the
original founding of our laws English lawyers. It would have required the united
enormities of a dozen or a more of the most guilty
among the Colonists of New South Wales to make up
a mass of guilt equal to that of the crimes of Titus that which issued from
Oates committed by this on murderous tongue.
