Of Unlawful Defamation.

14. The damage attending the loss of character
may be distinguished into general and special. The
general damage is the sum of unassignable inconveniences
that may result from such a cause:
the special damage is any particular assignable
inconvenience; such as the loss of an Office, owing
to the loss of the goodwill of the person who was
to have conferred it: the loss of the custom of such and
such persons in the way of trade; the loss of a marriage
with such or such a person, and the like.

15. The value of the general damage attending a
Loss of Character depends upon the circumstances:
1. The intensity of the disrepute. 2. The Duration of it.
And 3. The Extend of it. The intensity is measured
by the degree of Aversion or Contempt which the several
Persons whose goodwill is in question respectively entertain
or harbour towards the party on the account
