§ 89

Of Of the power here given to the Greenwich Treasurer, not
to speak at present as yet of distant Deputies: the exercise is not
made matter of obligation. It is matter of discretion
and in general presents itself does not seem exposed
to any considerable danger of abuse seems more not
so likely to be abused, as to by negligence and indifference
to be left unexercised unemployed where it might have
been exercised to advantage.† Unless the Solicitor has an influence. But if the power itself
be useful, the restriction here imposed upon it can not
but be pernicious. Before this Trustee General Guardian of the rights of Seamen can begin
to act, the for four months by is the length of time during
which under this provision in all cases the money must in all cases is under this power
seen to be left in the Agents hands. "Regular period of

But this is but the time for the first step, and to say
when the time of the last stage will come is not quite so easy.
"It shall be lawful for the Treasurer .... to cause the Proceeds
.... to be paid to him? ....; Good but by the what
means by which this desirable effect is to be produced?
what are they? useless if them on the part of the Agent
in whose hands the money is there be any unwillingness many of disinclination
to part with it, a lawsuit it must be, for there is no
other. To be sure Assuredly if on his intention, costs and so
forth considered, the will balance in case of litigation
will in his book be on the side of loss, he will not
stand it engage in it. But before the money is actually paid by
him there will of course be correspondence of which, the
distance at which it is capable of being carried on being indefinite the
duration, with the delay
and current interest
thus manufactured,
will be indefinite.
