But in whichever of the two opposite but though so intimately
connected principles sources of action, hope and fear and hope,
fear of ill repute, hope of good repute, the conduct and character of the functionary is considered as
depending, the force of the principle does not attach upon his character
and conduct, any further than as it is known.
So far as concerns decisions, and what passes in relation
ti them, in the only place in which anything in relation
to them (except it be in the mind of the Judge himself) ought
to pass, the character of the Judge is evidenced, his conduct
is constituted, by the discourses he delivers from the Bench:
so far, and so far alone only as those discourses are known,
so far and so far only is his character and conduct
known, for any good at least: for if he takes bribes, or
to private sollicitation, if these incidents to be seen no little information
can be obtained from anything that passes on
the bench.

To give competition as between Chamber and Chamber
as between Judge and Judge in the Court of Sessions under its
proposed division, what seems indispensably necessary is
that in of the discourses held by them on the Bench
everything, everything at least should be known – generally
known – as generally known, as the bestows operations of the press can
render them. But for the purpose of preventing this publicity
I see very considerable exertions made effectual measures taken under the existing order
of things, and for the preventing it I see no measures at all taken under the
learned Reformers improved order of things. But of this in the Omission.
