conveyance, speaking of the contract of called Sale, declares
that to all such contracts it lends it binding force
power for commands the Judge upon application from the
party to lend apply his power to the purpose of preserving
giving effect to them; except in certain cases specified,
such as frauds from, and so forth, of which a list
accompanied with the requisite explanations is given in and by
the law, those cases of exception are so many
events or situations, having, with relation to a title that would
otherwise be afforded by the contract sort of contract in question contract of sale as above, the effect
of ablative events or situations, as above.

No article in the this list of ablative events or situations
let be it supposed suppose for simplicity's sake, is alledged
by on the part of the defendant, as having place. Questions two:
question of fact, is the account given of the transaction as
delivered by the witness a true account does it appear to
you to be true? Question of law – does the transaction
as described by the evidence appear to you to amount
to a Sale – to come under the description notion conveyed by
that characteristic word of the law which is by the plaintiff is referred
to as being intended to include in its import the
all transactions of the nature of that which the evidence
that speaks of as having on the occasion in question taken
place?
