4 No provision
made for rendering
justice to those who
are unable to bear
the expence rendered
necessary

4. That whereas the aggregate of these three evils constitute no
more than one half of the aggregate of the evils opposite to the
ends of justice. But whereas it was the duty of every man in
his situation seeing the sufferings produced by the that same aggregate, he
include in his endeavours and proposed arrangements the whole thereof
and not to have any part thereof purposely untouched, he
the said Honble and Learned Gentleman, did in his said
Bill, one half of the said aggregate of evil purposely untouched:
namely that part thereof which has place, in every case, the
which there being no suit, such absence of suit suits have for the
cause, the expense necessary in one such to the institution
of the , on the other side, to the making defence
to, and on both sides each side respectively to the continuance of it,
and that in so far every instance in which this necessity
of expense has having place, the individual in question is thereby
rendered unable either to give commencement to the suit, or to
give continuance to it, as the case may be, the effect of such
expense is to produce, to the prejudice of that same individual,
a denial of justice.

5 Result of such
denial of justice to plaintiffs — oppression
on the part of the rich
at the charge of the
relatively poor

5. That of such denial of justice, the effect, in so far as it operated by preventing the commencement
of a suit, or the continuance
of it on the plaintiffs
side
is to deprive
of all remedy in every shape at the hands of the Judge against sufferance
by wrong in every shape: thereby establishing giving existence
and establishment to oppression to and for the benefit of the relatively
rich, at the charge of the relatively poor: and, in every instance
in consequence of contemplation of the unobtainability of such remedy
money or money's worth is obtained or retained by the
relatively rich at the charge of the relatively poor, depredation
as well as oppression. depredation, to wit wit by the means of observation made
of such denial, and any action past taken in this case by
lawyers in the production of the evil, and without view of any such action past
