<p>In a case of property, then – whatsoever be the<lb/>
 
subject matter – immoveable, movable, or incorporeal<hi rend="superscript">+</hi> –<lb/>
 
wherever <add>where</add> possession is in question – the question being<lb/>
who <hi rend="underline">is</hi>, and who is <hi rend="underline">not</hi> in possession of it, two <add>three</add> descriptions<lb/>
of <hi rend="underline">persons</hi> will have to be brought to view.  1. those<lb/>
who are in possession – 2. those <add>as</add> against whom they<lb/>
are in possession – 3. (if different from those against whom)<lb/>
those who are not in possession.</p>
<p><hi rend="superscript">+</hi> &#9758; Examine how far this holds good in the case of incorporeal<lb/>
subject matter.  For this purpose the several species<lb/>
of incorporeal subject matter must have been classed:  <hi rend="underline">grouped</hi><lb/>
and the groups divided if practicable in the <add>bifurcate</add> exhaustive mode.</p>
<p>Then as to the <add>beneficial</add> <hi rend="underline">effect</hi> of being in possession –<lb/>
the power <del>or</del> or the right, that <del><gap/></del> <add>the possessor has</add> for giving effect – to<lb/>
such his possession – to the relation he bears to the thing in question.</p>
<p><del>wh</del> 1.  If a <hi rend="underline">power</hi>, it is <hi rend="underline">sinejudicially</hi> exercisable:  i.e.<lb/>
the legal power of employing physical force by the hands<lb/>
of the power holder, or any assistants or substitutes of his<lb/>
in obtaining the <del><gap/></del> physical faculty of using the thing<lb/>
viz. by laying hold of it <add>the thing</add> in case of no <add>non</add> resistance:  2.<lb/>
<add>in case of resistance</add> by operating upon the persons and things by which<lb/>
the resistance is opposed.</p>
<p>2.  If a <hi rend="underline">right</hi> without <hi rend="underline">power</hi> <add>it is <del>in</del> no otherwise than judicially exercisable –</add> it is the right<lb/>
