Supplement
§ 11. Elucidation
3. Courts Martial

II Now as to the Official Establishment past part.

8
Justice of Peace Courts one of the two sorts in
accordance with proposed
System by their single
seatedness

In the case of one of of the two sorts of summarily proceeding
Justice of Peace of Courts, that is to say the single-seated
in say its accordance with the here proposed system and correspondently
supposed accordance with the ends of justice so far as regards this
same feature of single seatedness has been brought to view.

9
But defiled by mixture
of extraneous functions

But, at the same time, the defiliment defilement contracted by
the mixture of functions belonging to other branches of the Official
Establishment — namely the Legislative and the Administrative — are
also brought to vie view. In the particular the Scotch Small
Debt Courts have been stated as standing clear of imputation: not every where
completely so
not altogether as the English Small Debt Courts.

10
In number of suits
necessary disadvantages
of the many seated Justice
of the Peace Courts

In respect of the member number of the suits in the case of the it has been shewn
in how high a degree the
many- seated Justice of Peace summarily proceeding Judicatories
it has has been stated as greater and
the English Small Debt Courts labour under the disadvantage
huge opposite to that advantage.

12
As to parity from
incompatible functions
Courts Martial should
stand as high as here proposed
Courts

In respect of parity from all corruptive mixture
of incompatible functions the Courts Martial stand upon as
high
a height, nearly, if not quite, as high, as the its Judges
under the here proposed system.

13
In Courts Martial
however there are reasons
for substituting at present
many seatedness to single-seatedness

In respect of the number of the seats how every side; on which
consideration, in that part of the here proposed system which
regards the Defensive Persons observations has have place tending to
shew under what conditions, and for what reasons, it is supposed that single seatedness
might with advantage be substituted to the at present accustomed
many seatedness.
