One this occasion in nature there is
which it is absolutely necessary should be given and attended
to. This is that throughout perfect correctness a altogether free from incorrectness is in the very
nature of the case absolutely impossible. Suppose for example
a rule position which in the main is true, but no otherwise
is their subject to certain exception: and that this<lb?>the space necessary for the statement of these exceptions a quantity of space is necessary not less than the utmost which can
be allotted for the whole of the present sketch. Even though this
supposition is not in strictness realised, yet a state of change
sufficiently resembling it for the purpose of argument will be is unquestionably
will be found would upon examination be found unquestionably
to have place.
Moreover, what happens almost continually is — that against that which in the present sketch must
either be passed by altogether, or mentioned simply as if
not to open to dispute, objection and objections
may be raised, and thus by every objection shewn to
be open to dispute. This will in a more particular degree
the case with every position which for its ground or warrant<lb?>has no other sort of law than that which in contradistinction
to statute is indeed Common law. For this same Common Law not
having in any part of its extent any determinative forms
of words belonging to it, not any one man or set of men
who so much as pretend to have made it, it is that
of in of law scarcely can any one
practice be found that is not open to dispute.
Under these circumstances what is evident is —
that only for the general outline and spirit is of the description picture
be given drawn can the author of such a sketch be with any
propriety be considered as responsible: only
when so far as from any errors he it may have fallen into.
