Ch. or §. First continuation of the suit – First Suit non-penal Mutual
attendance judicial meeting in a non-penal suit how procured
Art. 1. A day and time being having by the summons or
prehension been warrant for appointed for the Defendants appearance at the
Judge Judicatory for the purpose of his meeting the pursuer in the presence of
the Judge, attendance is given either by both, or
by the pursuer alone or by the Defendant alone.
Art. 2. Saving sufficient causes of non-attendance If the on the side of the pursuer attendance
fails, by non-attendance has place the suit is as against the Defendant at an end, and for whatsoever costs
the Defendant has been subjected to by the it the pursuer is
