§. Judge's course in consequence of the first hearing – Options optimal steps

Art. 1. The applicant pursuer or Co-pursuer or
their respective proxies being heard the Judge will determine
whether to either dismiss the suit or to continue retain it.

Art. 2. If there the dismisses it be but one Applicant
he will with regard to that one applicant either dismiss it or retain
it.

Art. 3. If he dismisses it he will either dismiss
it purely and simply, or on the ground of its vexatiousness
punish the Applicant by fine.

Art. 4. If there be Applicants more than one
he will either dismiss it in regard to all, retain it in regard
to all, or dismiss it in regard to one or more or retain it
in regard to one or more: in case of dismissals adding or
not adding punishment as before.

Art. 5. If he retain with regard to one or more
he retains it, he will then consider whether, in regard to in
interestees one or more of the several denominations one or more
to exact preliminary security, and if yes in what
shape or shapes: to wit proper or extraneous: and in both cases
whether bodily or or both.

Art. 6. If in every shape, he will thereupon
ex either exact or forbear to exact at the charge of the
Applicants one or more, counter-security in one or more of its shapes.

Note as to Appeal. In case of dismissal, Judge Appellate if he disapproves
will order forth application to the same Judicatory either before the same Judge or a different
one, whether principal or depute.
