Offences resting in periculo x in gradu consummato. An act , regarded as an offence, & supposed to be productive of of a nature to produce a calamitous event
may be consider'd at two successive periods: before the event and
after. At the first period, the offence may be said to
rest in periculo: at the second it may be said to
subsist in in gradu consummato .


Nusances permanent x transient or fugitive See 37.

Nusances may be distinguished into permanent &
transient. I call a nusance permanent when the
instrument of mischief runs is such as from the nature
of it's destination continues for a length of time in that
state which whether of motion or rest which qu disposes
it to produce the mischief. I call a nusance permanent
transient only when the nature of the instrument of
mischief is not such as from the nature of its destination continues
to for any length of time in that state.


Nusances in general - what. By a Nusance I would mean any act or habit, whereby
a detriment to any one's person or property is or
is likely to be produced, such detriment not being among
the direct objects of the intention of the Auther of the
nusance.

Where it is to a man's property alone that a nusance
is or is obse likely to be detrimental , the case comes
under another head - viz: that of Injur Offences against
property. Where it is a mens property or person indiscriminately
this can it comes under the head of Offences
against person and property.
