Whatsoever, in a case of this sort, be the subject<lb/>matter of the demand. in will be in the joint care of<lb/>the Pursuer and the Judge, so to adjust the description<lb/>given of it, that in case of non-compliance, non<lb/>attained and non responsion on the part of the<lb/>Defendant, execution given to an <hi rend="underline">execution-ordering<lb/>mandate</hi>, issued by the Judge, may, without other<lb/>description that what is so agreed upon, suffice to<lb/>put the pursuer no possession of it. If for want of<lb/>sufficient information respecting the facts belonging<lb?/>to the case, the Pursuer can not taken upon him to fix<lb?>the amount, let him write in the appropriate space<lb?>the words "<hi rend="underline">not yet ascertainable, remains to be<lb/>ascertained from the evidence.</hi>"</p> <p>2. If although the demand be, in respect of the<lb/>collative fact, with grounds , the amount of the<lb/>subject matter demanded is, in respect of quantity<lb/>an assigned value manifestly excessive, the Pursuer<lb/>will be <del><gap/> to be fined</del> <add><sic>compensationally</sic> and <sic>punitionably</sic> responsible</add> in consideration of and<lb/>ascending to the amount of the excess: <del>it</del> <add>the demand</add> being to<lb/>the amount ungrounded, and <del>having, if levied the</del> <add>the exaction of the service<lb/>having the</add> effect of oppression and extortion.</p> <p>3. (b) [Effective Service]. Warning against excess
in the quantity or value of the effective service demanded.]
1. Whatsoever, in a case of this sort, be the subject
matter of the demand. in will be in the joint care of
the Pursuer and the Judge, so to adjust the description
given of it, that in case of non-compliance, non
attained and non responsion on the part of the
Defendant, execution given to an execution-ordering
mandate, issued by the Judge, may, without other
description that what is so agreed upon, suffice to
put the pursuer no possession of it. If for want of
