Penal Code

Instruments of delinquency Ch. 5
§ Deception

1
Evil & good instruments
of one are also
of the other.

2
To enumerate instruments
of evil would
be to enumerate the
Motives & the Acts
which they induce
Men to inform
such acts at any
rate as are apt to be
employed for the
production of ulterior
evil – all of them
with reference to himself
producing good
in the eyes of the Agent.

3
But there is a class
of acts always more
apt to be employed
for the production
of evil & not for the
production of good
which acts may be
named instruments
of deception
.

4
Falsehood in itself
neither good nor evil
but only an instrument
of good

of the end or say cause
be good of evil if the
end or cause be evil.

5
But however good
the immediate end
the general consequences
of Falsehood
are so far of an evil
nature that rarely if
ever they do not over
balance the particular
good.

6
if a man lies
but once it will so far
diminish the reliance
in his veracity. In
vain would the goodness
of his purpose be
alleged – this single deviation
would always
induce a belief in its
being the result of a
rule formed in his

wherever he believes
that it be may be
conducive to a good end.

But it may be said
that if such a rule
were prevalent every
man in uttering a
falsehood would do it

for his own interest
which he would consider
as a good end
& that this rule would
be an indemnification
for all falsehood.

8
Still by impartial
eyes would the distinction
be seen betn
falsehood for good
& for bad purposes
and if in one single
instance a man has
failed in this respect
in a good
Cause should that
be a reason why he
has made a failure
in an evil Cause.
Assuredly not.

9
In general the evil
effects of such a general
rule not so
great as they may at
first appear. Very
few are the Causes
where to the liar in the
bad cause the good
evil does not n his
own eyes appear preponderant
to the
general good.
