In actual practice in
the case of fraud the
wrongdoer fights off
the wrongee for years

In case of fraud, under the present practice in in the present mode in use in the Equity Courts
the Defendant wrongdoer threatens fights off the wronged party wronged
and continues in possession of the benefit of the wrong keeps him not in possession of his right during an
unlimited number of years: frequently till one or both of them have
departed out of life: in the proposed mode the wrongdoer being with
the party wronged being in the presence of the Judge, a few hours or a
few minutes would commonly suffice for ascertaining the fraud and producing
a decree in consequence.
