Penal CodeCh. 1. Offences by Use of property affecting body person
§. 1. Corporal vexation
To this genus of private offences corresponds
a genus of semi-publick offences; and, in both
cases, where the act has been or is about to be
multiplied, or say extended into a habit, the
preponderancy of mischievousness on the part of
the habit, will be apt to appear questionable
in such sort that the performance of it will
naturally be clear of evil consciousness: and
regulations in no small detail will be necessary
for the purpose of drawing a line of demarcation
between the cases, where the omission
of the act will be productive of more evil to one
party, than the restraint upon the commission
of it will be productive of, to the other party,
and those of the contrary description.
To this head belong the cases of trades,
regarded as noisome & the exercise of which is, in crowded towns, commonly inhibited
in the covenants inserted in leases. This topick may in the
advantaged be posted off to the non-penal Code. But under the head
of police, provision may with advantage be made, by timely regulations,
declaring in what situations such trades may be carried on and in what others in the
