Suit excretitious what
Suits original principal. Suits incidental or say excretitious,
By incidental suits understand those which in the case of a suit
having for its object the obtainment of a right, or for a way in
any shape the correspondent remedy, are liable to grow out of it.

Course the same as in an
original suit
In As to the mode best adapted to the purpose of Justice no adequate difference
can be is then assigned between the suits denominated in the one way and
those denominated in the other. To each belongs its commencement
its continuance and its conclusion to wit by performance of
execution sought or by the refusal of it. So far as the creation of
law is concerned reference to the test of the law so far as the question of fact is
concerned production of the body of appropriate and obtainable [and obtained] evidence
then as the operation requires as in the one case as in the other

of which the need and occasion and need are most apt to arise
1. Non compliance without excuse with a judicial mandate without reason or excuse
