attempt.

2dly That there are occasions in which in order to prevent the dissolution of the state it may be
necessary to or engage collect within a given a certain number
of persons in the services of the state it's defence in a less time
than the same number of persons could be brought
to engage themselves by their consent.

Here it is to be observed that in this behalf there
is no difference between it defence and attack:
since in many cases, the most effectual, or perhaps
the only effectual way of defending one's
self is by attacking.

These points being conceded, propositions being acceded to, it is manifest that
in every state a power of pressing must be lodged in some
hands or other: it consequently that the acting
in pursuance of a press warrant must be admitted
as a circumstance justifying an act of imprisonment
as well as such other personal injuries as in the
prosecution of such an intent it may become necessary
to inflict. In What hands in particular
it were most for the expedient to lodge
such a power, and what limitations if any it may admitt
of, are questions that belong to Constitutional
Law.
