Why Infancy is in no case made a ground
of total exemption.
Reasons
1. Because punishment in this case is neither
needless groundless, inefficacious unprofitable, nor needless. Where the infancy
is extreme, the party infant will stand
exempted in another ground: he will stand virtually be exempted
as being exculpated on the score of want some
of intention ground or grounds of extenuation; to wit, either
want of intention, ignorance of the law, or innocence
of intention. See Tit. [Simp. Pers. Injureas.]
