When Among the motives
It may happen that the knowledge opinion or the inclination of the one co-offender upon being <hi rend='underline'>when communicated</hi> may ope-
-rate in the characterway of a motive on the other: his opi-
-nion, as a motive to the inclination intermediately,
by being operating immediately as a motive in the un-
-derstanding: his inclination, as a motive to this operating
immediately on the will. inclination or will immediately. The communication of his
opinion on such an occasion is what is counsel or ad-
-vice. Now the communication of ones inclination re-
-cover a different name according to the nature
of the motive which the knowledge of it is calcu-
-lated to constablish. If the motive be a self regarding motive of the co-ercive
kind, it is s a command: if a self-regarding
motive of the alluring kind, and presented as a period previous to the formation of the inclination an invitation: if a
subsequently to that period, an encouragement: if
it be the idea of the a pain is pleasure
to accrue to the person who suggests it, to wit a
motive of the social kind, it is a petition.
Advice if accompanied with the manifestation of a strong
interest or inclination on the part of the adviser grounded on a sympathy for
the party advised, is st exhortation. A petition if ac-
-companied with the manifestation of a strong interest of the ill-regarding kind
of the adviser, is stilad an entreaty. NOTES (a) The tern sub has to seldom used
with repro to any other offence than Perjury: but it
may with equal propriety be used with reference to any
other.
