And Whereas if a person who<lb/><note>34<lb/>Person, erroneously<lb/>brought as a fugitive<lb/>or deserter, dischargeable<lb/><hi rend="underline">instanter</hi></note><lb/>never had been a Penitentiary Prisoner should by<lb/>any mistake be convey'd thither as a fugitive<lb/>therefrom or as a deserter from the Metasylum, the<lb/>innocence of such Prisoner in respect of such charge<lb/>must be fully know to all persons employ'd as<lb/>officers or otherwise in an about the said Penitentiary<lb/>establishment to a degree of certainty far superior<lb/>to what can in general be obtained in any ordinary<lb/>mode of trial Be it enacted that in any such<lb/>case upon a certificate given by the Chaplain & Surgeon<lb/>or any other two officers of the said Establishment<lb/>that the prisoner so brought to the said Establishment<lb/>as a fugitive or deserter as aforesaid never<lb/>had been a Prisoner belonging to the same the<lb/>Governor may forthwith give him his discharge.</p><p>Art. 35. And forasmuch as by means of<lb/><note>35<lb/>Any one compellable<lb/>to show whether he is<lb/>marked -</note><lb/>the identification mark abovementioned a certain<lb/>criterion is afforded in virtue whereof no person<lb/>who shall not have been a felon convict and as<lb/>such committed to the said Penitentiary House<lb/>can ever on suspicion of so being be arrested without<lb/>his own <sic>wilful</sic> obstinacy & default Be it<lb/>enacted that any person who suspects another<lb/>of being either a fugitive from the Penitentiary<lb/>House, a deserter from the service of a Friendly<lb/>Guardian</p> | ||
