Tothill Fields. Plan of Division - with Observations

the Dean & chapter on the one part, & the
Parish or Parishes on the other part, touching
the extent of their respective rights, in relation
to the Waste in question.

That, to save the expence & delay of a Chan-
-cery Suit, on a ground of such intricacy, & in which
such a variety of evidence, antient & modern, writ-
-ten &amp: oral, may require to be investigated, produ-
-ced, & commented upon, a clause be inserted
for submitting all such differences to arbitration.

that a valuation be made of the whole
of the Waste, including as well the reserved
portions as above, as the portion proposed to
be leased out to the Crow: & that, iof the share
adjudged by the award to belong to the Dean &
chapter be greater in value than the part
hereby proposed to be reserved to their use in kind,
a proportionable part of the pecuniary equi-
-valent be allotted to them accordingly: if less,
that in that case, the reserved part, as above, be
charged with a proportionable sum or annuity
to be paid by them to the use of the Parish or
Parishes —

N.B. the possession of the satisfaction
reserved in kind seems more competent to
the situation of the Dean & chapter than to
that of the Parish or Parishes.

1. Because the management & improvement
of land seems a function better suited to the condi-
-tion of a small & permanent body, such as the Dean
& chapter, than to that of a numerous & in some mea-
-sure fluctuating body, such as the Vestries, select as
they are, by which the business of the Parishes is
conducted.
