1. If there were no other means of saving avoiding the use of exemptingdelinquents from the
punishment of death than the giving encouragement to perjury
on the part of Jurymen the encouragemntmischief thus done thus given
whither useful upon the whole or not, would not be absolutely

as well as more simpleefficacious made of exemplary avoiding the
use of this pernicious mode of punishment is in man's
power, viz. the not abolishing it ceasing to employ it.

2. If there were no otheron the part of the legislator means of avoiding the use of the
punishment of death than the giving encouragementcony at the disobedience to
the Judge and immediately practiced by in the subornation of perjury in the part of
Jurymen, the mischief thus done, whither productive of
real advantage or no upon the whole, would not be absolutely
devoid of use. But on the particular occasions
in question as inon all otherothers occasions a much more
surely efficacious as well as more simple mode of avoiding the
use of this pernicious mode of punishment is in mans
power, viz. the ceasing to employ it.
