<p>Having laid before the Lords Commissioners of His Majesty's<lb/> Treasury, your Letter on the subject of M<hi rend="superscript">r</hi> Bentham's<lb/> Memorial, respecting the necessity of an Increase of Charge in<lb/> the Terms of his Contract for creating a Penitentiary House; I have <lb/>received their Lordships Commands to acquaint you, for the <lb/> Information of his Grace the Duke of Portland, that on considering<lb/> the number of years which have elapsed since the first steps<lb/> were taken, with a View to the Adoption of any Plan of this Kind, <lb/> and the Variation of Circumstances which have occurred during <lb/> that Period; the improved state of the Colony of New South Wales,<lb/> as appears by the Enclosure transmitted by his Grace in the<lb/> letter above-mentioned, as well as the various improvements<lb/> which have since taken place in the different Gaols in this Kingdom,<lb/> and the great increase of Terms which M<hi rend="superscript">r</hi> Bentham now<lb/> proposes; their Lordships are of Opinion, that it would not be<lb/> expedient to carry into Effect this Plan to the whole extent proposed<lb/> by the M<hi rend="superscript">r</hi> Bentham, but they submit to his Grace whether, <lb/> by the Experiment, it may be fit to carry it into Effect<lb/> in a more limited Seale, or whether under all the Circumstances,<lb/> it may be most advisable at the present Time to relinquish<lb/> the Plan altogether. In the latter Event, their Lordships will<lb/> feel it incumbent on them to make such Compensation to<lb/> M<hi rend="superscript">r</hi> Bentham as the Loss he has sustained in preparing<lb/> for this Undertaking may appear to them to deserve.</p>

received their Lordships Commands to acquaint you, for the
Information of his Grace the Duke of Portland, that on considering
the number of years which have elapsed since the first steps
were taken, with a View to the Adoption of any Plan of this Kind,
and the Variation of Circumstances which have occurred during
that Period; the improved state of the Colony of New South Wales,
as appears by the Enclosure transmitted by his Grace in the
letter above-mentioned, as well as the various improvements
which have since taken place in the different Gaols in this Kingdom,
and the great increase of Terms which Mr Bentham now
proposes; their Lordships are of Opinion, that it would not be
