<p><hi rend="underline">Expositive</hi></p>
<p>Art. <del>13</del> 11. Cases of <hi rend="underline">indigent rapacity</hi>, or say<lb/> of <hi rend="underline">rapacious</hi> or <hi rend="underline">predatory indigence</hi>. By this appellative<lb/> may be designated the class of cases which,<lb/> on this occasion, are principally in view, in: <lb/> these cases, the nature of the offence <add>being <del><gap/><gap/></del></add> <del>being</del> such,<lb/> that <del><gap/> is <gap/></del> <del>that</del> without the stimulus of relative<lb/> indigence <add>seldom is a person</add> <del>persons are</del> led into the commission<lb/> of it.</p>
<p><hi rend="underline">Expositive</hi></p>
<p>Art. <del>14</del> 12. Of offences of this description, the<lb/> following may serve for examples: <add>for</add> adequate<lb/> <add>denominations and</add> definitions <add>see the Penal Code</add> <del>belong not to this code</del>.</p>
<p>1. <hi rend="underline">Fraudulent obtainment</hi>; <add>that is to say, obtainment</add> with consent<lb/> procured by deception, without supposition of<lb/> title on the part of the delinquent, or intention of<lb/> <add>making repetition, or of</add> <del>restitution or</del> being amenable to law.</p>
<p>2. <hi rend="underline">Theft</hi>: that is to say, caption without consent,<lb/> or supposition, or pretence of title, or intention<lb/> of restitution, or of being amenable to law.</p>
<p>3. <hi rend="underline">Robbery at large</hi>: that is to say, caption by force, <lb/> or obtainment by consent, extorted by means of immediate<lb/> or unpreventable injury, to body, mind, property<lb/> or reputation.</p>
<p>4. <hi rend="underline">Highway Robbery</hi>. That is to say, on a much<lb/> frequented road, street, or other public and open place.</p>
<p>5. <add>Day</add> Robbery <del>in the day time</del>, in conjunction with<lb/> Housebreaking.</p>
<p>6. <add>Night</add> Robbery <del>in the night time in conjunction</del><lb/>with<add>out</add> with Housebreaking</p>
<p>7. <add>Night</add> Robbery <del>in the night time in conjunction </del><lb/> with Housebreaking.</p>
<p>8. <add>Day or Night</add> Robbery <del>in the day or night time</del>, with<lb/> or without Housebreaking, but in conjunction<lb/> with Homicide <add>that is to say with homicide: intentional as to that effect, as well as the act, and <sic>arbitter</sic>,<lb/> in relation to the robbing</add>: <hi rend="underline">preparatory</hi>, <hi rend="underline">concomitant</hi> or <hi rend="underline">consequential</hi>:<lb/> preparatory, for preventing resistance; <lb/> concomitant, for subduing resistance; consequential,<lb/> for punishing resistance, or for security against<lb/> justice.</p>

Expositive

Art. 13 11. Cases of indigent rapacity, or say
of rapacious or predatory indigence. By this appellative
may be designated the class of cases which,
on this occasion, are principally in view, in:
these cases, the nature of the offence being being such,
that is that without the stimulus of relative
indigence seldom is a person persons are led into the commission
of it.

Expositive

Art. 14 12. Of offences of this description, the
following may serve for examples: for adequate
denominations and definitions see the Penal Code belong not to this code.

1. Fraudulent obtainment; that is to say, obtainment with consent
procured by deception, without supposition of
title on the part of the delinquent, or intention of
making repetition, or of restitution or being amenable to law.

2. Theft: that is to say, caption without consent,
or supposition, or pretence of title, or intention

3. Robbery at large: that is to say, caption by force,
