<p>Guardian or the Metasylum, or a quondam Penitentiary<lb/> Prisoner after whom search is making<lb/> on suspicion of any offence may on declaration of<lb/> such his suspicion summon the person so suspected<lb/> to exhibit the part on which the identification<lb/> mark, if any, will have been imprinted:<lb/> and if the person so summoned, not having in<lb/> such part an ailment whereby from the exposure<lb/> thereof serious mischief might probably ensue, shall<lb/> refuse or wilfully forbear as soon as conveniently<lb/> may be, to exhibit the same, any person or persons<lb/> then present may, using as little force as<lb/> may be; proceed thereupon to expose & inspect<lb/> the part, or if that cannot then be done, to arrest<lb/> and detain the suspected person <sic>untill</sic> such<lb/> inspection can be accomplished: and the person<lb/> so refusing, although he or she were never a Penitentiary <lb/> Prisoner, nor ever had in effect any<lb/> such mark, shall on conviction before any one<lb/> Justice of the Peace forfeit for the trouble and<lb/> hindrance so occasioned any sum not less than<lb/> 2<hi rend="superscript">s</hi> nor more than 20<hi rend="superscript">s</hi>.<lb/><add>Art. 36.</add></p> | |||
