a comparatively very small proportion be
applied to the subordinaate and so justly suspected
situation here in view.
Speaking of a man in this situation, in vain, as a reason for omitting any arrangement common in this situationIn vain would it be said of the
him of the sort of business he can haveendeavours to obtain, the quantity will be
dependent upon the goodness of his reputation: upon that, character; and
thence upon the actual general probity upon the appropiate
moral aptitude- of his conduct. This quantity
of this observation, one half, though but the small half to him: but the other half is false of the business he canmay expect to obtain the quantity will depend
upon two sorts of customers: sutomers of mutually
opposite descriptions: namely The one sort is that of the sincere or relatively
honest litigant; and ofthe other, that of the insincere or relatively
dishonest litigants
First, as to the sicere honest litigants. In so far as, in
his eyes, they are able to detect any sacrifice he
might be disposed to make of their interests to his
more sinister interests, viz, by giving increase to
the quantity of delay vexation and expence for
the sake of his profit upon the expence, - in so far
it will not in his eyesview of the matter, be his interest employ his talents in the endeavour to endeavor
to make the sinister sacrifice. But numerous
will be the occasions, on which, in his
view of the matter, they will not be able to detect
those endeavours, which it will be in his
power to use: on all these occasions, therefore,
thatsuch endeavors shd. actually and constantly be directed to the making
of the sinister sacrifice, is no more than what
ought reasonably to be expected, and by all apt expedients
provided against. Suppose even that, in this
or that instance they are not thus exployed, still in the opposing
of all possible bars to their being successfully employed, Thus there
is at any rate no harm done.
